Hershey wins lawsuit arguing halloween candies weren’t spooky.

A federal judge ruled that some popular Halloween candies are a treat, not a trick. The judge dismissed a misleading advertising lawsuit against The Hershey Company. They were accused of tricking customers who got disappointing candies when they bought Halloween versions of Reese’s products.

The suit targeted nine Reese’s products, from pumpkins and ghosts to bats and footballs. They claimed that they received blank Reese’s candies when they expected ones with pumpkin faces, ghost eyes, and bat details.

Two Florida men, Nathan Vidal and Eduardo Granados, were seeking at least $5 million in damages, Reuters reported.

“Vidal was very disappointed and would not have purchased the Reese’s  products if he knew that they did not have the detailed carvings of the mouth and/or eyes as pictured on the products’ packaging,” the suit said.

US District Judge Melissa Damian ruled that the treats not being spooky enough doesn’t prove economic harm.

“Put simply, the plaintiffs do not allege that the products were unfit for consumption, did not taste as the plaintiffs expected, or otherwise were so flawed as to render them worthless,” Damian wrote “Rather, the plaintiffs allege that they were “disappointed” that the products they purchased did not have the detailed carvings pictured on the product packaging.”

looks like blue cross finally settled their class action lawsuit

for $14 billion, 991 million dollars, and some change

when reading through my letter of settlement

i see they used class action lawsuit math to arrive at my payment

 my $3 thousand and some dollars spent on what they considered ‘relevant purchases’

(plus all of my dollars spent with them that were considered ‘irrelevant’ )

are worth an award of exactly 5 cents.

which they noted, ‘of course is less than $10 dollars’

will be donated to free clinics of michigan (a good cause)

so perhaps the donation on my behalf

will help to purchase exactly 1/2 of 1 bandaid for someone.

yes, i know it’s not cheese, but something about this sauce is like liquid gold to me

A Florida woman filed a class action lawsuit against Kraft Heinz … claiming its Velveeta Shells & Cheese prep time is not actually “ready in 3 1/2” minutes, as advertised.

She states that the 3.5 minutes is only the amount of time the food has to go in the microwave and claims it takes more time to actually prepare the meal — don’t forget you’ve got to pour water into the cup and stir in the cheese sauce.

She doesn’t say how long it takes her, but claims the 4 steps listed in the directions — remove the lid and cheese sauce pouch, add water to the fill line and stir, microwave for 3 1/2 minutes, and then stir in the cheese sauce — don’t equate to the mac actually being READY to eat in that time frame.

She’s also looking to put together a class of customers who might also be upset about the prep time and says the damages will exceed $5 million.

“We are aware of this frivolous lawsuit and will strongly defend against the allegations in the complaint,” the company reportedly told USA Today.

 

*editorial opinion: what if she was to devote all of the time and energy and money it is taking her to create, publicize, rally people, and carryout this lawsuit, and instead, use it as the ‘extra unplanned prep time’ she feels she is wasting and it requires, when making her shells and cheese? or, make it from scratch and compare the prep time needed. just a thought… (beth)
